1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of this website and your purchase of products and services from Air Now Supply ("ANS," "we," "us"). By using this site, placing an order, or requesting a quote or repair, you agree to these Terms. If you are using this site on behalf of a business, you represent that you are authorized to bind that business.

2. Products, Catalog Information, and Errors

We sell industrial replacement parts, including filtration products and carbon vanes, and provide repair and related services. Product descriptions, cross-references, compatibility notes, images, and specifications are provided for identification and convenience. Manufacturer part numbers, trademarks, and brand names are used for cross-reference and identification purposes only and do not imply endorsement by, or affiliation with, the trademark owner. Aftermarket parts are identified as replacements suitable for the referenced equipment and are not represented as original-equipment parts unless expressly stated.

We work to keep catalog information accurate, but errors in pricing, imagery, specifications, or availability can occur. We reserve the right to correct errors, update information, and cancel orders affected by errors, including after an order is submitted. If we cancel an order for this reason, we will notify you and you will not be charged (or will be refunded in full).

3. Fitment Confirmation

Correct fitment depends on information you provide (part numbers, equipment model and serial numbers, dimensions, and application details). We are glad to confirm fitment before you order — and for certain items we require it. You are responsible for the accuracy of the information you provide, and for final confirmation that a part is appropriate for your application.

4. Quotes, Orders, and Acceptance

Some items and all repair services are sold on a quote-first basis and are not available for direct online checkout. A quote is an invitation to order, not a binding offer, and is valid for the period stated on the quote (or 30 days if none is stated). All orders are subject to acceptance by ANS. We may decline or cancel any order, including for suspected error, unavailability, or credit reasons.

5. Pricing and Payment

Account pricing shown after login is specific to your business account and may not be shared with third parties. Prices exclude taxes, shipping, and freight unless stated otherwise. Where an order requires confirmation of stock, freight, tax status, or fitment, your payment method may be authorized at order time and charged when the order is confirmed, as described at checkout or on your quote. Payment terms for approved business accounts are as agreed with ANS in writing.

6. Shipping, Freight, and Risk of Loss

Advertised same-day processing applies to in-stock, parcel-eligible items ordered before the stated cutoff (currently 2:00 PM Pacific Time), and is subject to stock confirmation. Oversize and freight/LTL shipments are quoted and confirmed before you are charged. If you elect to ship on your own carrier account, you are responsible for that carrier's charges and terms. Unless otherwise agreed in writing, risk of loss and title pass to you when the goods are delivered to the carrier. Please inspect shipments on arrival and note any damage with the carrier at delivery.

7. Returns and Exchanges

Wrong or unused stocked parts in resalable condition, in their original packaging, may be returned for exchange or credit within 30 days of delivery with prior authorization from ANS. Contact us before returning any item so we can issue return instructions. The following are not returnable unless defective or shipped in error: special-order and non-stocked items, items that have been installed or used, and items not in resalable condition. Return shipping is your responsibility unless the return results from our error. Where a return results from our error, we will make it right, including return shipping.

8. Repair Services and Rentals

Repair, rebuild, and rental services are scoped and quoted individually. Repair work is backed by our workmanship warranty covering the work we performed, for the period stated on your repair quote or invoice. The workmanship warranty does not cover unrelated failures, normal wear items, misuse, or damage occurring after redelivery. Rental equipment remains ANS property, must be returned in the condition received (normal wear excepted), and is subject to the rental terms provided at the time of rental.

9. Warranties and Disclaimer

New products carry the manufacturer's warranty, if any, which we pass through to you to the extent permitted. Except for the express workmanship warranty in Section 8 and any non-waivable rights you have under applicable law, all products and services are provided "as is" and ANS disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow limitations on implied warranties, so parts of this section may not apply to you.

10. Limitation of Liability

To the maximum extent permitted by law, ANS is not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, downtime, or loss of production — arising from or related to the site, products, or services, and our total liability for any claim will not exceed the amount you paid for the product or service giving rise to the claim. These limits apply regardless of the theory of liability and even if we were advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Business Use

This site and our products are intended for business and industrial use. You agree to use products only in accordance with the manufacturer's documentation and applicable safety requirements, and to ensure installation and service are performed by qualified personnel.

12. Accounts

You are responsible for the accuracy of your account information and for activity under your account. Negotiated pricing, quotes, and account terms are confidential to your business. We may suspend or close accounts used in violation of these Terms.

13. Intellectual Property

Site content, including text, layout, and images we created, belongs to ANS or its licensors and may not be reproduced for commercial purposes without permission. Manufacturer marks and images remain the property of their respective owners.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The parties will first attempt in good faith to resolve any dispute informally. Any action that cannot be resolved informally will be brought exclusively in the state or federal courts located in Orange County, California, and the parties consent to their jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time you place an order applies to that order. Material changes take effect when posted.
